You just simply use the common sense not to look at those blaze orange spots amongst the green and brown background. Doing it just gets a bad rap from those hunters not smart enough to scan with naked eye at the same time and avoid pointing their weapon at someone.

Not trying to thread-crap but let's not forget a hiker dressed in black was misidentified, shot and killed by a hunter in skagit a few years ago this way. If memory serves the range was reported as like 140 yards. One life lost and many lives destroyed including the 14 year old hunter, and the hikers young kids. Using your scope attached to your rifle to look around and identify game is not acceptable. It is a nice buck.
