State orders owners of newly-banned, unregistered firearms to turn them all in

The State of Connecticut is now demanding that gun owners across the state turn in all newly-banned, unregistered firearms and magazines or face felony arrest.

The State Police Special Licensing & Firearms Unit began mailing out notices to gun owners who attempted to register their firearms and accessories with the state but did not do so in time for the Jan. 1 deadline of Connecticut’s newly enacted gun control law.

The law bans the sale of magazines holding over 10 rounds and “assault rifles” manufactured after 1994 and requires that residents who possessed either before the ban to register them with the state.

“We are returning your application for [an] assault rifle certificate and/or [a] large capacity magazine declaration because it was not received or postmarked prior to January 1, 2014 as required by law,” the notice states.

The letter breaks down the gun owner’s “options,” including surrendering their firearms and magazines to the police, selling them to a gun dealer, removing them from the state or rendering them inoperable.

Because these owners attempted to register their guns and accessories, the state can now prosecute them at will because they know exactly who they are.

But when it comes to the vast majority of gun owners who did not register at all, Connecticut lacks clout.

Last month it was revealed that out of the over 2.4 million high-capacity magazines in Connecticut, only 38,000 have been registered.

There are some very brave people in CT.

Registration always leads to confiscation. I applaud the brave gentlemen in CT and hope that people in every other state that enacts unconstitutional laws have the same response. Unconstitutional laws are illegal and should not be obeyed.

Now that I looked closer at the letter. It is dated Jan 2nd. I don't think they would have sent them out that soon if they were requiring that the application had to be postmarked by the 1st.

Declaration of Large Capacity Magazine(s) - DESPP-788-C 
 
You must declare your magazine(s) prior to January 1, 2014.  Any application received after that date will be returned unless post marked on December 31,2013.
 
Please fill out Declaration and if available, attach copy of original sales receipt describing your purchase prior to effective date of Public Act-13-3 as amended by Public Act 13-220.  If you do not have your original paperwork, you may compose an affidavit/statement, stating that you owned the magazine(s) prior to the effective date of Public Act 13-3 as amended by PA-13-220, and have the affidavit notarized prior to mailing or dropping it off at the Special Licensing and Firearms Unit office.  Please make sure that you sign your paperwork in front of the notary.

FFL Large Capacity Magazine Transfer to Dealer Form - DPS-416-C1 
 
Effective January 1, 2014; Federlly Licensed Firearms Dealers must submit this form for any
LCM(s) taken into inventory from a private individual.
 



Assault Weapons: Public Act 13-3: An Act Concerning Gun Violence Prevention and Children’s Safety:
Assault Weapon Ban effective by Public Act on April 4, 2013

Newly defined Assault Weapons:

Any newly defined assault weapon that was lawfully purchased on or before April 4, 2013, but was not transferred by that date, may be transferred pursuant to such lawful purchase and a sales authorization number may be obtained for such transfer.  Sellers are required to verify that a lawful purchase occurred on or before April 4, 2013 prior to transferring such firearm.   

Proof of lawful possession will also be required by DESPP from the owner of the firearm with the Application for Certificate of Possession of Assault Weapon.

Lets say the certificate application was dropped in the mailbox just after pick up on December 31st. It gets picked up and post marked January 1st after the dead line. Now add 2-3 day delivery time for 1st class letter delivery according to the USPS web site, and you have the letter being received on the 3rd at the earliest. Unless they somehow knew who was applying before the applications were actually received, that letter is phony.

I hope those holdouts stick to their guns; pun intended. I read about this awhile back. The CT pols were mystified as to how few mags and PDF's had been turned in or registered. I wonder when they'll muster the backbone to go house to house.
