It's happening again! Numerous bills have been introduced in the 2016 Legislature which seek to outlaw and destroy your right to keep and bear arms as a law-abiding citizen. More gun control measures!

This Thursday, Jan. 21, 1:30 p.m. in House Hearing Room A of the John L. O'Brien Building, the House Judiciary Committee has scheduled public hearings on four very destructive bills designed to whittle away your gun rights. They include:

•   House Bill 1747 - Would create the crime of child endangerment due to unsafe storage of a firearm.

•   House Bill 2461 - Would establish extreme risk protection orders to temporarily prevent an individual from possessing, accessing, or purchasing firearms while that individual poses a significant danger of harm.

•   House Bill 2372 - Would allow for the destruction of forfeited firearms.

•   House Bill 2460 - Authorizes cities, towns, counties, and other municipalities to restrict the possession of firearms in any designated public park space,  recreational facilities, libraries and on any mode of public transportation and transit facilities.

While these concepts may not appear to be bad in theory, it's the principle which strikes me -- more gun control measures from those who don't understand that it's our constitutional right to keep and bear arms!

The entire subject of gun control is extremely personal to me. Several years ago, a criminal used a gun to shoot and kill my uncle. It was devastating to me and my family.  You might think because of this horrible tragedy that I would be working hard to eliminate guns. But the simple fact of the matter is that guns don't kill people. People kill people!

If all of these gun control measures were implemented years ago, I do not believe it would have changed the outcome or saved my uncle's life. Evil doers exist in the world. They care nothing about laws government creates. While law-abiding citizens are denied the right to bear arms to protect themselves, law-breakers will continue to find a way to obtain firearms and use them against defenseless individuals.

When I consider proposed gun control bills, I ask myself, would it have stopped the shooting of my uncle? I have yet to find any gun-restrictive legislation that would have changed that outcome.

Many law-abiding people collect guns. Some don't even shoot their firearms. Since the possession of a firearm doesn't hurt anyone, why should the possession of a gun by a peaceful citizen be considered a crime?

What about the rights to defend oneself? With predatory criminals running rampant, why shouldn't law abiding citizens have the capability of bearing arms to defend themselves?

These latest measures chip away at our constitutional rights. I will oppose any such measure, especially gun control bills, which does that.
I strongly encourage you to mark your calendar and come to Olympia and testify in defense of your gun rights this Thursday, Jan. 21 in front of the House Judiciary Committee. Each of us must remain continually vigilant to protect and maintain our basic individual rights as guaranteed by the constitution of the United States. That includes you!

I see Oregon's doing the same thing; on the mental illness garbage thing they're trying to pass. They don't' even allow the person to know who made the report or have any kind of recourse to sue the person who made a false report. Only some language that it will be a misdemeanor for anyone making a false report.

Prozanksi’s Secret Accuser Bill Formally Introduced

Today the Senate Judiciary Committee formally introduced Floyd Prozanski’s LC 250 which we told you about earlier this week. The bill was introduced as a “Committee Bill” which means Prozanski won’t have his name on it.

As you know, this bill will allow totally unqualified people to make anonymous accusations against others and claim those people are experiencing “mental health emergencies.” Those people lose their rights to buy a firearm.

These accusations will not be investigated, the accused will not know the accusation has been made unless they try to buy a gun nor will they be allowed to know who their accuser is or how long their rights will be suspended.

If they choose to challenge the accusations, they assume the full burden of proving they are not mentally ill and all of the expense.

The Committee approved the bill on a 1 to 3 vote. All Democrats voted yes, Senator Thatcher voted no and Senator Jeff Kruse is recovering from surgery and was absent.

Today’s vote was not a vote to pass the bill out of committee. It was to formally introduce the draft as a bill.  The next step will be actual hearings on the bill during the coming session in February.

It is interesting to note that another draft is being considered. This is LC 217 which establishes a tip hotline to report threats to students such as “cyber bullying.”  That proposed legislation would require that any tip be investigated to determine if it is authentic. LC 250 provides no such protection for people who will lose their gun rights.

We will continue to monitor this legislation as it moves through the system. Be prepared to take action and contact your legislators who can be found here.

The Soviet style, false accusation bill we told you about Tuesday has been updated.  Clearly this draft is being “worked” and almost surely will be introduced in February. A copy of the latest version can be seen here.

We have been reliably informed this is actually Floyd Prozanski’s bill, although Ginny Burdick had previously announced her intention to introduce legislation of this type.

As we told you Tuesday, this bill would allow a laundry list of unqualified people to make a secret report and accuse you of “experiencing a mental health emergency” at which point you lose your right to purchase a firearm.  You would not be told this report was filed against you, you would not know who filed it or when it expires.

A few changes were made from the version we shared with you Tuesday.

First, they have changed the definition of one class of “reporters” from “family members” to “immediate family members.” The bill also now has vague language about a misdemeanor penalty for “knowingly” making a false report . The worst a person faces for stealing your rights and your good name is a misdemeanor.

They have also added a standard duration for the hold that would be placed on you. Under this second draft, your rights would be stripped from you with no due process for 30 days.  Nothing in this draft would prevent your accuser from simply requesting another hold after 30 days.

Included in the list of people who can make a secret accusation against you are school personnel who have “had direct contact with you.” It does not say “recent” direct contact. They could have had “direct contact ” with you ten years ago.

It also allows any any doctor, “health care provider” or “licensed mental health professional” to make a secret accusation against you. As with family members, those “reporters” are not required to have direct contact with you.  So, for example, a person like Senator Elizabeth Hayward, who is a doctor but also openly admits to having severe mental health issues, could initiate a secret report against anyone she wanted even if she did not know him.

Imagine coming to the Capitol to testify against an anti-gun bill like this. Hayward, who has been a vocal, anti-gun extremist, could pick up the phone or simply go online, report that you are experiencing a “mental health emergency” and, without your knowledge or  right to face your accuser, your rights evaporate.

If you find out that this has happened to you because you attempt to buy a gun and are denied, it’s up to you to prove you are not a danger to yourself or others. You would either have to find a “health care provider”  who would provide “documentation” that you are not a danger, or you would have to go to court, at your expense, and “demonstrate by clear and convincing evidence” that you are not a danger to yourself or others. Good luck with that.

This new version comes the same day we have received the latest statistics from the Oregon State Police on background check denials. (Keep in mind, the OSP does not make public information on their, far more common, delays.)  Once again their own statistics prove what a farce this system is. In December of 2015 OSP denied 226 attempted transfers.

Of those OSP claims that 174 were denied because the buyer was a felon.

11 were denied for “mental health” reasons.

24 people were denied because the OSP claims the gun in question was stolen and 17 people were actually wanted by the police at the time of the attempted purchase.

The number of arrests made? A grand total of …zero.

So according to the OSP, 191 people who were felons or wanted by the police were trying to buy guns, and exactly none were arrested.

Clearly adding this new category of “prohibited” persons will only increase the complexity and failure rate of this monstrous system.

To the members of the Washington State House Judiciary Committee,
 
I am writing to you today to ask that you STRONGLY oppose the radical anti-gun legislation that is being brought before you.  Common sense has seems to have left the building.   I believe each are a gross violation of this states citizen’s constitutionally protected 2nd amendment rights and should be thrown in the trash.  The 2nd amendment was written not for hunting, but to protect the free people of this country from a corrupt tyrannical government, I do not understand why the Democratic legislators of this state/country keep conveniently forgetting that fact.  The type of weapon or the size of the magazine is irrelevant.  I am a hard working single father, and a law abiding citizen, raising an 8 year old son on my own, my job is to protect my child.  I cannot do my job when the lawmakers of this state/country are cutting my arms off, due to an irrational fear.   I was raised around firearms and was taught by my father to be safe and responsible.  The fact of the matter is, 99.99% of the gun owners in this state/country are law abiding citizens, and these proposed Bills do nothing but bring undue punishment on law abiding citizens, all they do is turn good people into criminals.  This cannot be allowed.  Drunk drivers kill far more people in this state than firearms, but I do not see anyone trying to ban cars?  And 80% of the people killed by firearms are self-inflicted/suicide.  California or Chicago, Il., for example, have the strictest gun control measures in this country, and in both cases crime/murders went through the roof as soon as gun control was implemented,  criminals and crazy people will always find a way.  Not one of the recent mass shootings would have been prevented by gun control.   They were perpetrated in “gun free zones” and all it would have taken was a responsible citizen with a Concealed permit to stop the threat and save lives.  I believe that the real problem is the breakdown of families in our society. Too many parents unfortunately are not doing their jobs.  Enforce the laws already on the books, stop the revolving door in our current justice system allowing violent criminals free before their sentences are up, and make sure they are put on a cannot own firearms list.  Make mental healthcare easier to access, and those that are proven in a court of law mentally incompetent be added to the list of those who cannot buy/own firearms.  Make gun-safes easier/cheaper to get for the average person.  I-594 closed all the loopholes RIGHT?  So the only people that should be buying/owning guns are proven law abiding citizens. Please do not punish the good law abiding people of this state.  It is completely irrational to punish the many for the actions of the very few.  Firearms are being sold at record rates, even by the liberal constituency.  With the increased threat of terrorist attacks, people are scared.  Seeing what is going on in Europe with the Syrian refugees and our esteemed Governor allowing those same refugees into Washington, people are afraid for their families.
 
HB 2354 - I am sure that you are already aware of what the 2nd Amendment says, but I would like to call attention the words “shall not be infringed,” and I would ask that Mr. Moeller figure out what those words mean.  Both I-594 and our Presidents executive orders closed all the loopholes, again RIGHT?  So this Bill does only one thing, punish good law abiding people who do not deserve to be punished.  This bill is horribly written and is so open ended.  Where are the crime stats to back up the reasoning for this Bill?  Answer?  There are none, people have a better chance at winning the lottery than an AR being used to perpetrate a crime.  They are used to target shoot, hunt varmints, shooting competitions, and are used to defend our homes.  The Original AR was the Kentucky long rifle, it was far superior to what the British were using at the time so in 1774 they were banned from import, in 1775 the British attempted to confiscate them, and in 1776 the American revolution started.  Our country was founded on innovation, there are plenty of practical uses for these firearms, and the current laws prevent the wrong sort from owning them.  So once again, WHY are we trying to punish good law abiding people?   Absolutely ridiculous.  Also limiting the size of magazines is once again an attempt to infringe upon law abiding citizen’s rights.  George Washington once said, “A free people ought not only be armed and disciplined, but they should have sufficient arms and ammunition to maintain a status of independence from any who might attempt to abuse them.  Which includes their own government.”  Please strongly oppose this garbage Bill.

HB 2374 - Yet another attempt by Representative Senn to violate this state’s 2nd amendment rights of this state’s law abiding firearm owners.  ‘Shall not be infringed”, this bill places an undue burden on good people.  It will do nothing but place the blame of criminal activity and violence on her law abiding constituents.  Please strongly oppose this garbage Bill.

HB 1747 -  This Bill is completely not necessary, firearms are at the very bottom of the list of items that are causing injury or death to children, and in those rare cases where adults are truly negligent, the existing reckless endangerment statute is more than adequate.  Case in point, the father of the Marysville shooter, he is on his way to jail as we speak.  This bill is redundant, once again, fix our justice system and enforce the laws that we already have in place.  Please strongly oppose this garbage Bill.

HB 2461 – Another attempt to violate constitutionally protected rights, shame on you Representative Jinkins.  Innocent until proven guilty, every citizen has the right to a fair trial.  Fix the current system.    Every person has that vengeful ex that can easily fabricate false stories, our current laws are more than adequate, enforce them.  If a family member is in danger they can call the police and have that person put in jail, then give the firearms to a trusted relative, to keep that person or persons safe.  This isn’t California Ms. Jinkins, we don’t need more unnecessary laws.  Please strongly oppose this garbage Bill.

HB 2372 –  Shame on you Tara Senn, more unnecessary legislation.  Our existing laws allow local municipalities to sell seized and forfeited firearms to raise money for local public safety.  HB 2372 repeals that opportunity.  Please strongly oppose this garbage Bill.

HB 2460 – Not only would this effectively take away the right of self-defense in these public places, but it would be a huge first step in weakening the preemption statute and opening the door to allow for the local prohibition of firearms.  The preemption statute is put in place to prevent local municipalities from creating a patchwork of complex and confusing gun laws that could ensnare gun owners unaware of the laws.  The people that would or should be carrying firearms in these places would be CWP holders, proven safe and endorsed by local law enforcement officials, if I-594 closed the loopholes, this bill does nothing but endanger good people and their families, we all have the right to defend ourselves.  Criminals and terrorists do not give a crap about signs or laws.  Protect instead of endangering good people.  Please strongly oppose this garbage Bill.

HB 2481- Please support this Bill

To close I would like to remind the representatives in particular those from Democrat party that the constitution and in particular the 2nd amendment is every citizens protected right.  It was written to protect good/free people from a corrupt government, not hunting.  “Shall not be infringed” should be the front of your minds.  We are a free people, our representatives exist to serve the good people of this state, Please stop trampling on law abiding citizens protected rights.  The anti-gun bills listed above do nothing but put innocent people in danger and punish those who follow and obey our current laws.  Shame on those who created these anti-gun Bills. Actually I like this: this lets them know you mean business. When I used to write letters to Clinton, Tom Foley, All Gore and the like back in the Ninety's I always wrote letters like this. Most of the time if their for what your against they'll just say thanks but no thanks, giving you all their reasons why the do support such garbage. Patty Murray wrote me a long winded letter once stating she knew what I meant by Majoritarian tyranny, but still supported Clintons Gun ban.
So by me  Even the ones you know will support it no matter what are good to write too.

actually I'd be against this one, for one there is already the NFA act of 1933, or there about's so why is this one needed?
GOA for one are against any machine gun bans so...
Machine guns are as much a part of our second amendment rights so why is it this one that gets trampled on the easiest?

actually I'd be against this one, for one there is already the NFA act of 1933, or there about's so why is this one needed?
GOA for one are against any machine gun bans so...
Machine guns are as much a part of our second amendment rights so why is it this one that gets trampled on the easiest?

Can you explain again why you would be against this bill? Do you think SBRs are bad and we shouldn't have them for some reason?

This bill is supposed to clear up language from 2014 that allows possession of SBRs but did not specifically allow manufacture. It has nothing to do with machine guns. Did you misunderstand what the bill is about?

Please vote for this one, to get another stupid restriction out of our state laws.

plus I know the History on NFA, and it only came in because of the ST- Valentines massacre which was years earlier and part of Prohibition at the time. But he Passing of the NFA act was a year or two after Prohibition was appealed, thus making the reason for the act a mute reason.

Meaning they want to allow SBR's=short barreled rifles that's ok with me don't care just don't ban something else that's already kind of banned without a NFA stamp to begin with.

I think you don't understand this bill. Machine guns are already illegal under Washington State law, nothing in the bill changes that.

This bill only changes the verbage about legalizing SBRs. It does not change anything else. Current law allows us to own SBRs, this bill would allow us to manufacture them also; nothing else changes. The strikethrough part here is the only change to an already existing law:

(2) It is not unlawful for a person to ((possess, transport, acquire, or transfer a short-barreled rifle that is legally registered and possessed, transported, acquired, or transferred in accordance))manufacture, own, buy, sell, loan, furnish, transport, or have in possession or under control, a short-barreled rifle, or any part designed or intended solely and exclusively for use in a short-barreled rifle or in converting a weapon into a short-barreled rifle, if the person is in compliance with applicable federal law.
