Ticket for no license
« on: April 04, 2016, 09:13:04 AM »
A friends son was cited this weekend for fishing without a license. Him and his friend (that had a license) went to a open lake to fish. The one with the license and the one pole had to go use the restroom so he handed the pole to the other kid without the license. The game warden was watching with binos and came down to the dock and cited him even though he wasn't holding the pole at the time or had caught fish while holding the pole for 2 minutes while his friend used the bathroom. Is this ticket worth fighting? Do you think a judge would dismiss it? Seems to be a waste of time for wardens to worry about such petty crap. Maybe the 150$ ticket is what they are after?

Technically it is a violation, but complete bs if that is really what went down.  If it is a civil infraction and not a criminal one, there is nothing to lose fighting it.  Just like a speeding ticket would depend on the mood of the judge.

Yes it is petty crap but from what you have described he was fishing without a license therefore the judge would have no grounds to dismiss.  Pay the fine and chalk it up to a learning experience.

I look forward to seeing it go down on “Rugged Justice”.

Take it to court if officer dosnt show say that the officer miss identified kid. Might work. Hopefully karma catches up with the d bag officer.  There is a special place in hell for someone who would do that to kids having a good time fishing.

Sounds like a hard up rookie looking to write a ticket. It's a shame because from your description there was no intent to break a law. Tough break and I think I would fight it on behalf of the kids.

Sounds pretty typical to me. Power trip LEO. Probably made his day. Did the kid cry when they got the ticket I bet that would have really made the Leo feel good.

Probably would get dropped if you went to court with it. You might even get in touch with the WDFW and find out which DA's office it would go to and call them. They clearly don't have time for this when they let that Cambodian guy walk.  :dunno:

I thought perhaps wrongly so that part of the mission of the game warden was to educate people using the outdoors. In this case the warden had an opportunity to "educate" the youths as how to their actions broke the law  since no fish were caught a warning could have been issued. If the wardens goal is to turn off future sportsmen he did a good job of it.

17 years old. Comes from a great family and has always followed the rules. I just hate to see him have to pay for something so petty. Due to not wanting to miss school he will probably just pay it.

Ya that's pretty typical. When I say we need to downsize government, the first thing that comes to my mind is the number of LEO's. You can't drive down the road without seeing a LEO every 5 cars in my home town. They need to write lots of tickets to pay their gas bill for driving big V8 engines around all day. Should be in a Prius.

And it seems to always be a car less than a year or year and a half old.  Those 2014 models just won't cut it for gov work, but Windows 2000 is the new great software.

The WSP cars we service are mostly brand new-ish. 2014 Explorers and  by the time they're 2 or so years old, they usually have 80-100k miles on them at that point. Once they're 3-4 years old they'd be over 200k miles. From a reliability standpoint, when should they be retired?

Granted it's petty, but he did technically break the law. Is he old enough to know better?
