ACTION ALERT: Washington: One Anti-Gun Substitute Dies in Committee, Substitute HB 1122 is Headed to the House Floor.

Substitute HB 1122 (https://app.leg.wa.gov/CMD/Handler.ashx?MethodName=getdocumentcontent&documentId=c-pUW3fgnxQ&att=false) would require the locking up of one's firearms or else they would potentially face reckless endangerment charges.  Further, under this bill the penalty for a reckless endangerment charge involving a gun storage violation would amount to a Class C Felony.  This intrusive government legislation invades people's homes and forces them to render their firearms useless in a self-defense situation by locking them up.

Substitute HB1122 is a bill concerning the criminalization of the storage of firearms in a manner deemed not responsible by whoever charges and prosecutes under the proposed law. This bill is not justified. According to data compiled by the National Shooting Sports Foundation Firearms-Related Injury Statistics Report (2015) (http://www.nssf.org/pForm/index.cfm?pform=l/127421/2016-08-08/rlxcy), unintentional fatalities in the U.S. involving firearms has dropped by 65% over the last 20 years, and by 27% over the last 10 years. Unintentional firearms-related home fatalities decreased by 64% over the last 20 years, and by 20% over the last 10 years.  Firearms account for only 0.69% of unintentional fatalities in the home. Other issues with the bill: It diminishes the ability of self-defense, and the storage requirements do not specify where the requirements apply. How would this apply to hunters in the field? Unfortunate accidents will always happen and criminals will always be able to obtain firearms. This bill is just another misguided attempt to demonize firearms and turn law-abiding citizens into criminals.

Today, the House Judiciary Committee considered substitute bills for House Bill 1387 and House Bill 1122.  Thanks to your calls and emails, House Bill 1387, and its substitute bill that we reported on yesterday, didn’t receive a vote and have officially died in committee having failed to pass before the deadline.  Unfortunately, a Substitute for House Bill 1122 was passed out of committee and will soon be on the House floor where it will await full consideration.  It is more important than ever that you contact your state Representative and urge them to OPPOSE the Substitute for House Bill 1122.

HB 2130 Creates crime of endangering a minor by allowing access to a firearm. Punishes by maximum of 30 days’ imprisonment, $1,250 fine, or both. Increases penalty to maximum of six months’ imprisonment, $2,500 fine, or both, or one year’s imprisonment, $6,250 fine, or both, depending on location at which firearm is possessed. Increases penalty to maximum of five years’ imprisonment, $125,000 fine, or both, if any person is seriously injured or killed. Requires gun dealer to post notice concerning obligation to prevent minors from accessing firearm without consent of minor’s parent or guardian. Prohibits transfer of firearm to person convicted of endangering a minor by allowing access to a firearm for five-year period after conviction.
