Yep, Common Garden Spider.  In spite of their size they are pretty mild-mannered critters.  Years ago, while swimming, I walked right into a 7 foot round web that was stretched between two bushes with the big fella in the middle of the web about chest high.  Didn't have my glasses on and never saw him until I felt him bounce off my bare chest and the web all over me.  Don't know where he went, but I was backtracking real fast with cold sweat running off and the hair on my neck sticking out.  He must have figured there was no sense in biting something that was too big to eat, because I didn't get bit, even though I destroyed his home.
If it was easy, everybody would be doing it.

When Bernie Madoff did it, it's called a "Ponzi Scheme"
When Government does it, it's called "Social Security"

they are the ones responsible for a majority of those cool web pics with dew on them you so often see in books.   Cool critters and welcome in my garden anytime.

Relationship to Humans:

Black and Yellow Garden Spiders are harmless to humans. Because they are large, many people fear them; however, not only are they harmless, but they do a lot of good. These spiders eat large amounts of insect pests, such as flies, mosquitoes, and aphids.
