I'd hunt it while walking away. Wouldn't dare us another hunters personal property despite where they left it. It would be different if it were a structure in a tree or something that they couldn't prove was theirs.

As far as bait, call a game warden and collect ur ten points.... Baiting is not legal. Where did you say this was? :)

Baiting deer and elk is perfectly legal

WOW, your saying collect 10 points against another hunter for doing something legal (baiting deer and elk is). I would read the regs if I were you before assuming something illegal.


I would not sit in the stand but may hunt over the salt lick if the owner of the stand was not there. If he showed up I would politly move to another area. that's just me though.

Well I think it depends. If you are talking about a portable stand on public land. Than I say stay out of it but feel free to hunt that spot. There are no dibs on public land.

If you are talking about a stand built into a tree on public land first come first serve.

Same with blinds. I use a hub blind. I come along and you are in it we are going to have words. I come along and you are sitting next to it , I should have got up earlier.

Duck blinds. Many are contructed by hunters on public land, first come first serve.  Portable I would stay out of but again I would hunt the area if I were there first.

During the elk season I have left my hub blind up for several days and got into it before light every morning. No one bothered it or came around other than to pass by.

So who are you realy???Baiting is legal for deer elk cougars , rabbits, skunks,moose,coyotes,  almost everything but bears...

oh and NO it's not ethical to hunt someones stand area.   Tel last couple years I've been pushes out of an area out of Trout Lake that I have been baiting for 30 yrs . and can walk in to in my old age...LOL. The hunter even stole my block and moved it over the hill. ...If I was 20, 30, or even 50 again I would be hunting better places! The elk and deer are in these  stand areas only for a short time then go elsewhere... don't hunt other peoples stand areas.

public land, i see no problem hunting the same area its public land but id make sure no one was around and move on if he/she showed up.

as for the tree stand id say that is a big no no to sit in the person's stand, if its not my property i dont touch it.

I guess i always thought if i hung my stand on public land and someone was in it , they just got up earlier than me , and more power to them.Maybe it is because i am a long time duck hunter and thats how we do it in the salt flats...

When I hang stand son public I am anticipating that someone else might use while I am not there. And that is ok with me. I understand public land is public and when I hand a stand that is a chance I take. I think it is considerate if I arrive to use stand early in the Am and someone is there he/she would climb down and defer to my use. If not I wait till the person climbs down after the hunt and move to a more remote area.

If you bait on public be prepared for others to hunt over it.

I'd say your actions were just fine and respectfull of the other hunter.  I praise you for that!

But using someones tree stand just becasue its on public property is wrong.  That stand is someones private property.  You wouldn't sleep in someones tent or take a drive in their car if you found it on public land, would you?  I'm quite shocked at how many say they would use it.  But, then again ethics in the Washington hunting woods has been going down hill at a rapid rate the past few years.

I don't think its legal to build a permanent stand on public land.

Public land or not it is personal property so you as the stand owner are personally responsible for any injuries if someone falls out of the stand or the stand breaks.  Thus, many states now consider the use of someones stand without permission "trespassing" whether on private or public land.  However, in most of those states you can not set-up a public property stand more than 24 hours before the season and it must be taken down within 24 hours after the season.  This way everyone has the chance of being there first.
