be careful hunting a previos baited area. game warden's are checking up this year. to much baiting going on. there making you show them were bear was killed. just saying be careful. and it is not legal to bait for trail cam's. no baiting period. Rick

Because the wording of the RCW doesnt say anything about baiting for non hunting purposes.

As defined in RCW 77.15.245 bait is defined as “a substance placed, exposed, deposited, distributed, scattered, or otherwise used for the purpose of attracting black bears to an area where one or more persons hunt or intend to hunt them.”

That is some really grey area because you can bait for deer, elk, coyote ect.   You are saying if a bear came into my deer bait I now broke the law?  They would have to prove that you were baiting specifically for bears and that you hunted for bears over it.

I think they can nail you on the Intend to hunt part.   Thats one of those grey RCWs that can be interpreted in oh so many ways.

Yes definitely grey area.  I mean how can they prove that you intend to do anything?  Of course I am assuming that they still need to prove you guilty in this state.  If I had a tree stand set up over a pile of apples or mineral lick during deer season I guess I am automatically a criminal.  Does not surprise me I guess since I must be a poacher because I want to carry a handgun while bow hunting.    I am really starting to hate this state.

Yes Kain it doesn't matter if your bait was intended for Deer or anything else.You shoot a Bear over it and a Warden finds out your gonna get in trouble.

Yes I totally agree.  The point I was making was the "intend" to hunt bear over it.  How would they prove that?  So until you actually kill one are you breaking the law or not?  Thats what I was trying to say.  Bearmanric was saying that Officer Mark James says no baiting at all even for trail cameras.

LongTat,  a good friend would have shot that little bear then picked all the berries in the area and peed all over (in that order...some of you guys need to be told these things  ).  Then laughed at your buddies sore ass after he wasted a whole day out there on stand.
