ATVs have nothing to do with this story. It's the guys who stole the deer and that's it.
I don't really understand how this turned into a debate about ATV use. Like I said I do not know if it was legal for them to have the ATVs back there or not, I do not ride them and there were no signs posted, so I wouldn't know. Them being on ATVs isn't what made me angery becasue the guys on the ATVs didn't come around til the guy who tagged my deer called them on his radio. Here is my on the ATVs though, I don't care what it is if it is illegal and you knowingly commit the crime then you should be punnished, so if it were illegal for them to have their ATVs back there they should be punnished for their actions. If you are an ATV rider you should be angry also, the actions of these people are the reason why you are finding it harder and harder to find land to ride on. The poor judgment of a few can ruin a good thing for all. If it is wrong then it is WRONG period. As for shooting the deer in retaliation the only thing this would accomplish is a deer that gave it's life to just sit and rot. These people and people like them wouldn't have tagged the deer if the meat were to have been shot to hell. Although I am still angry about it I am going to keep hunting. I don't care if I find something larger, I just want/need meat in the freezer. One good thing came from this, my older brother who is a police officer said that if it happens again that I would be justified in using force. I was alone, they became hostile first and all of them had fire arms. If it came to it, I could claim I felt my life was being threatened and could use any means to get myself to a safer position even if that meant pulling my side arm. I hope I never have to do this, just as anyone who carries a side arm hopes they never have to use the thing but it is nice to know I could if I needed to. I never felt I was in that much distress just angry at the lack of respect and sportsmanship of these people. If I weren't so angry when I left the woods I would have done more to get even. I was just hurt by their actions. They seemed like decent people when we talked prior to heading in. If I do wind up eating my tags I still have the experiances and that although it would be nice to have a freezer full of meat is what hunting to me is really all about. I have stories and knowledge to pass onto my daughter and grandchildren. One last thing let it be known they are VERY VERY VERY lucky that my daughter was not with me when all this went down.

So yes, ATV's behind locked gates would be a WDFW Officers "problem". As I have said on here many times, trespassing is the most frequently dropped case in WA, no matter what county. There is however a law that is applicable to ATV/ORV/Jeepers, etc which prohibits them from entering land without landowner permission. It is a $134 traffic infraction.

The game warden can pursue an infraction against me ? Give me the RCW please. I'm getting two sides of the law here.

Is an investigation into a shooting, possible arrest, if arrested then lawyer fees, etc. worth some F-in venison? I don't think so. I've spent good hard earned cash on lawyers for some fist-a-cuffs when the losers went to the police cry babying about the lumps, bruises and such. I keep as calm as I can and believe me it is REAL hard because I have a temper like greased lightning. Go take a CCW class and find out the legal and financial consequences that follow a shooting. Then you may not be so fast in saying my bother said...police are not the legal system they only enforce what the lawyers and courts have dictated.
I talked to a landowner who participates in the "hunt by written permission only" program. He did it because he would catch guys trespassing and 9 out of ten times it would get dropped in court. So he went with that wdfw " by written permission only" program and said now if someone trespasses its a wildlife violation and 9 out of 10 times he gets a conviction. And the conviction has more weight.
You shot and they shot, maybe they are somewhere talking about a guy who tried to steal thier deer? Could it have been an honnest mistake? Sounds like they were jerks for hunting right by you tho. I think you did right, I would never die or kill over a deer. As for vandalizing the cars, you would be letting the creeps turn you into a creep. I would not do that either.Carl
