Fraleys fines and jail time was 100% suspended, he received two years probation on his third wildlife offense.  As my mom stated he probably took his @$$ to the food bank and ate the elk he killed too.  Good job Pend Oreille county justice system.. :bash:

What was the orginal story on this poached elk? I don't remember.

The guy must have a great lawyer or he's related to the judge. That's BS.

I'm on my phone otherwise I'd dig up the first link.  He shot the bull with a rifle that an archery hunter was calling in.  The archery hunter called and reported .

In this case the only thing that wasn't suspended is the criminal wildlife penalty assessment, which in this case would be a $6,000 civil fine because it was a trophy bull. The only reason this wasn't suspended is because under state law the assessment can't be suspended.

The criminal fine and jail time were suspended.

Unfortunately this is the NORM! It's very rare in big game poaching cases nowadays for somebody to get anything other then just the criminal wildlife penalty assessment...

Well I feel a little better about it if he had to pay a $6,000 fine. That is still a substantial amount of money, for most people. So he didn't get off that easy.

I wonder if he will ever be able to buy a hunting license again, and if not, how long before he can?

Doubt that being able to buy a license will deter him.  He's probably laughing at the state now and waiting until the bulls are out of velvet so he can poach a few more.

I think its a minimum of two years on the suspension of hunting privileges in this kind of case.

Big tex, they did suspend the fine. It was 7000 ish dollars, all suspended. He paid 0$

That's illegal to do under state law. The criminal fines can be suspended, however under state law the criminal wildlife penalty assessment cannot be suspended, this is why the assessment was created.

Yes they would. Simply unlawfully taking a big game animal is a $5,000 criminal fine. Each gross misdemeanor offense is $5,000 and each misdemeanor is $1,000.

Well you have to look in two places. A conviction for unlawful hunt big game in the second degree carries a suspension of hunting licenses for 2 years. A conviction for unlawful hunt big game in the first degree (previous big game convictions OR the act was thrill/spree killing) carries a 10 year suspension.

Now on top of that, a license suspension stays in place as long as the criminal wildlife penalty assessment is not paid in full.

So if a guy was convicted today and paid his criminal wildlife penalty assessment today he will be suspended for 2 years. But if he doesn't pay off his penalty assessment for 5 years then his licenses are suspended for all 5 years.

This is typical in any criminal activity in any state. He'll keep doing it because he can. He doesn't give a rip.

Why is this? I can understand not putting someone in jail when they're overly crowded with more serious criminals, but if they're going to fine 1/2 the way on fines, why not go all the way??

All a poacher, wildlife trafficker has to do is not worry about it. Have you guys read OPERATION CODY ? Great guys and gals do great jobs to pin these pieces of crap and then the upper echelon and court system muffs it all up :bash: atleast  the piece of garbage had to pay something, albeit not nearly enough, he shouldn't ever be allowed to hunt, fish or ever own a gun or fishn rod again either.....KEEP AFTER THEM GAMIES, HOPEFULLY YOU WILL HAVE MANAGEMENT TO BACK YOU SOMEDAY..... :tup:
