ATVs have nothing to do with this story. It's the guys who stole the deer and that's it.

 
Sure it does, and the reason I asked if they were legal to be in there with ATV's, is that I don't see how he could turn those guys into law enforcement for "stealing" his deer. Where's the proof? It's his word against theirs. I don't think a game warden would be able to do anything, even if he had got license plate numbers and called it in. However, he could have turned them in for being behind a locked gate on ATV's. Very few areas here on the westside is it legal to go around gates on ATV's.

WDFW Officers can enforce any state law. So yes, ATV's behind locked gates would be a WDFW Officers "problem". As I have said on here many times, trespassing is the most frequently dropped case in WA, no matter what county. There is however a law that is applicable to ATV/ORV/Jeepers, etc which prohibits them from entering land without landowner permission. It is a $134 traffic infraction.

I don't really understand how this turned into a debate about ATV use. Like I said I do not know if it was legal for them to have the ATVs back there or not, I do not ride them and there were no signs posted, so I wouldn't know. Them being on ATVs isn't what made me angery becasue the guys on the ATVs didn't come around til the guy who tagged my deer called them on his radio. Here is my  :twocents: on the ATVs though, I don't care what it is if it is illegal and you knowingly commit the crime then you should be punnished, so if it were illegal for them to have their ATVs back there they should be punnished for their actions. If you are an ATV rider you should be angry also, the actions of these people are the reason why you are finding it harder and harder to find land to ride on. The poor judgment of a few can ruin a good thing for all. If it is wrong then it is WRONG period. As for shooting the deer in retaliation the only thing this would accomplish is a deer that gave it's life to just sit and rot. These people and people like them wouldn't have tagged the deer if the meat were to have been shot to hell. Although I am still angry about it I am going to keep hunting. I don't care if I find something larger, I just want/need meat in the freezer. One good thing came from this, my older brother who is a police officer said that if it happens again that I would be justified in using force. I was alone, they became hostile first and all of them had fire arms. If it came to it, I could claim I felt my life was being threatened and could use any means to get myself to a safer position even if that meant pulling my side arm. I hope I never have to do this, just as anyone who carries a side arm hopes they never have to use the thing but it is nice to know I could if I needed to. I never felt I was in that much distress just angry at the lack of respect and sportsmanship of these people. If I weren't so angry when I left the woods I would have done more to get even. I was just hurt by their actions. They seemed like decent people when we talked prior to heading in. If I do wind up eating my tags I still have the experiances and that although it would be nice to have a freezer full of meat is what hunting to me is really all about. I have stories and knowledge to pass onto my daughter and grandchildren. One last thing let it be known they are VERY VERY VERY lucky that my daughter was not with me when all this went down.

I know how it did, you mentioned an ATV and that's all it takes from the ATV haters.

Well bigtex, the retired game warden I know says it's not. He has told me I can ride my ATV anyplace. He, as a WDFW Game Warden, employee of the state of Washington can ride on a state issued ATV anyplace as along as he or I have a helmet on. I know game wardens can write tickets for any infractions, speeding, DUI etc. So you're saying, if I ride my ATV on private land that the WDFW Game Warden can ride on that gave access to the public, that's an infraction ? The game warden can pursue an infraction against me ? Give me the RCW please. I'm getting two sides of the law here.

Think about your statement for a minute. Is an investigation into a shooting, possible arrest, if arrested then lawyer fees, etc. worth some F-in venison? I don't think so. I've spent good hard earned cash on lawyers for some fist-a-cuffs when the losers went to the police cry babying about the lumps, bruises and such. I keep as calm as I can and believe me it is REAL hard because I have a temper like greased lightning. Go take a CCW class and find out the legal and financial consequences that follow a shooting. Then you may not be so fast in saying my bother said...police are not the legal system they only enforce what the lawyers and courts have dictated.

So you're saying, if I ride my ATV on private land that the WDFW Game Warden can ride on that gave access to the public, that's an infraction ? The game warden can pursue an infraction against me ? Give me the RCW please. I'm getting two sides of the law here.

I am completely lost by your first sentence.

I said there is an infraction that can be used to cite people who ride on roads that the landowner prohibits such use. An officer could also use trespassing charges, however as I said, trespassing charges often get dropped. A lot easier to give a guy a $134 traffic infraction then to try and have a county prosecutor press criminal trespass 2nd degree charges

RCW 46.09.450.3:
It is unlawful to operate an off-road vehicle upon a private nonhighway road if the road owner has not authorized the use of off-road vehicles.

RCW 46.09.450.4:
Nothing in this section authorizes trespass on private property.

So if Joe Landowner has somebody riding ATV's on his private roads and does not allow such actions/does not allow trespassing, any law enforcement officer (does not need to be WDFW) can either cite the offender under RCW 46.09.450.3 or go for Criminal Trespass 2 charges.

Never once have said I wanted to or even thought of using my side arm when all this went down just giving info I received from someone who knows. I understand his job and he has been doing it for a long time now and has a lot of interactions with lawyers. He has been involved in the investigation of a few self defense shootings so I trust what he says. I didn't go to him for the info he just gave it on his own accord. I DO NOT want to EVER use my side arm. I am pretty level headed that is why I walked away. If it ever came to it I know I would be under investigation but it is nice to know that it is in my brothers professional opinion it would be a quick and easy investigation. Please don't misunderstand my comments I do not want to cause anyone any harm I am not like that. With that said I do carry a side arm for safety and I am highly skilled in using my weapon. It would take an awful lot for me to use my weapon. I believe in the law and justice system. I also believe these pukes will get whats coming to them eventually. Again I was only passing along information that I have received, in now way was I making the statement that I would be in the woods like Rambo trying to find altercations with idiots. This situation is behind me now and I have learned from it.

I talked to a landowner who participates in the "hunt by written permission only" program. He did it because he would catch guys trespassing and 9 out of ten times it would get dropped in court. So he went with that wdfw " by written permission only" program and said now if someone trespasses its a wildlife violation and 9 out of 10 times he gets a conviction.  And the conviction has more weight.

Thats the great thing about this program. If you are prosecuted and found guilty of criminal trespass 2nd degree and were hunting there is no wildlife violation, thus it doesn't count towards the license suspension process. However if you are hunting on the WDFW Written Permission Properties without the permission card you will be cited for a RCW 77 violation and it will count towards the suspension process.

THe only thing bad about that program is that the land owner picks and chooses the people who get to access his/her property.  They will only allow family and a few friends it is all BS.  It looks and feels like the public has access but in all respect it is just a loop hole for the land owner.  I think the land owner needs to grant access to more then just family and the same folks to get in the program. 

The program needs to be revamped  :twocents:

You shot and they shot, maybe they are somewhere talking about a guy who tried to steal thier deer? Could it have been an honnest mistake? Sounds like they were jerks for hunting right by you tho. I think you did right, I would never die or kill over a deer. As for vandalizing the cars, you would be letting the creeps turn you into a creep. I would not do that either.

but knowing how foul 4 year old Deer estrus hidden safely in the cab of my ranger stinks, pouring it in the cowling ahead of their windshield would really STINK when they turned on the heat lol! (yes i am a dick like that and would have poured away)
