We got ticket with no loss of license in SD but it was not from the regs, it was a landowner that flat out lied, which was why no license loss. It was just the word of the land owner that could not be proven either way.
The regs (as has been stated) are as bad in SD as Washington’s fishing laws.
Check, check, check and call F&W if you need to verify.
I did that here on some fishing regs just this week to verify what I was reading. The officer I talked to was glad I called, even though I had read it correctly.
Good on the kid to own it and warn others to read the regs.

I would love to see heavier penalties for wildlife violations across the board.

I also think self-reporting should be the biggest mitigating factor by a long shot. Calling yourself in shows you didnt intend to break the law, and arent trying to hide it. Failing both of those metrics should result in loss of license and require re-taking hunters ed to get it back.

Swans and Canadian geese fall under federal law and treaties with other countries.  Yes unfortunately states can enforce heavier but thankfully can’t fall below the federal laws.  Good conversation with out smoke screens with hands waving in the air with cups and saucers flying into walls and windows from others speaking in metaphor of course.  None the less huge differences in punishment especially when it comes to a bird that absolutely has no season in our state that should cause no type of confusion.

Believe me I know about the MBTA.

Yes states must follow federal law when it comes to seasons, bag limits, etc. But they can enact lesser penalties. As an example under the federal MBTA law any migratory bird violation can result in a $0-$15,000 fine in federal court. Yet under WA law someone who goes over their waterfowl bag limit faces a $0-1,000 fine in state court if they've gone over up to two times their daily bag limit.

You also need to understand it's been damn near impossible to get any wildlife criminal offenses in WA prosecuted for about the past decade which is why WDFW is constantly going to the legislature asking to make certain wildlife crimes infractions (tickets) instead of criminal offenses. It's to the point now that WDFW is proposing to have big game offenses be able to he cited as an infraction, this would've been unthinkable 20 years ago.

For some reason I don't think prosecutors in the Dakotas are facing the outrageous criminal caseload like they are here.

They would probably just say that bird learned it’s lesson and it probably won’t do it again.

Stumbled onto this YouTube video and they talk about what they did wrong in about the last 2 minutes of the clip and what happened afterward from the game warden.  All professional of course.
